1. About Capy Studio These Terms & Conditions govern the provision of digital marketing services by Capy Studio (ABN: 23 264 584 678), operated by Christoph Langenmaier, based in Sydney, NSW, Australia. By engaging Capy Studio, you agree to these terms.

2. Services Capy Studio provides digital marketing services including but not limited to SEO, content marketing, email marketing, analytics, web builds, social media management, paid media, branding, and AI-assisted marketing workflows. The specific scope of services will be agreed in writing prior to commencement.

3. Proposals & Agreements All work begins with a written proposal or statement of work outlining scope, deliverables, timeline and fees. Work commences only upon written acceptance of the proposal and receipt of any required deposit.

4. Fees & Payment

  • All fees are quoted in Australian Dollars (AUD) and are exclusive of GST where applicable

  • Invoices are payable within 14 days of issue unless otherwise agreed in writing

  • A deposit of 50% is required before work commences on new projects

  • Late payments beyond 14 days may incur a late fee of 2% per month on the outstanding balance

  • Capy Studio reserves the right to pause work on overdue accounts

5. Revisions & Changes

  • Proposals include a specified number of revisions where applicable

  • Additional revisions or scope changes will be quoted separately

  • Significant changes to project scope may require a revised proposal and additional fees

6. Intellectual Property

  • Upon receipt of full payment, the client owns all final deliverables created specifically for their project

  • Capy Studio retains ownership of any tools, templates, frameworks, or methodologies used in delivering services

  • Capy Studio reserves the right to display completed work in its portfolio unless otherwise agreed in writing

7. Client Responsibilities The client agrees to:

  • Provide timely feedback, approvals and access to required materials

  • Ensure all content and materials provided to Capy Studio are owned by the client or properly licensed

  • Designate a primary point of contact for the engagement

8. Confidentiality Both parties agree to keep confidential any sensitive business information shared during the engagement and not to disclose it to third parties without prior written consent.

9. Liability Limitation

  • Capy Studio's total liability for any claim arising from services provided shall not exceed the total fees paid for the specific project giving rise to the claim

  • Capy Studio is not liable for indirect, consequential, or incidental losses including lost profits or revenue

  • Capy Studio does not guarantee specific marketing results such as rankings, traffic levels, or revenue outcomes, as these depend on factors outside our control

10. Termination

  • Either party may terminate an engagement with 14 days written notice

  • Upon termination, the client is liable for payment of all work completed to the date of termination

  • Deposits are non-refundable once work has commenced

11. Dispute Resolution In the event of a dispute, both parties agree to attempt resolution in good faith before pursuing formal legal action. Australian law governs these terms, with disputes subject to the jurisdiction of the courts of New South Wales.

12. Changes to These Terms Capy Studio reserves the right to update these terms at any time. Current terms are always available at capystudio.com.au/terms.
